Terms and Conditions of Sale

- Ownership:

Michelle Myrick and AMMO ARTWORKS INC. (referred to as The Artist) hold the copyright for all 'works' created. This includes works of art such as paintings, prints, books, music recordings as well as coaching products and services.

The Artist retains title to all 'physical works' until the physical product is sold and the Artist is paid in full at which time the title is transferred to the buyer. The Purchaser will receive a Bill of Sale.

- Reproduction:

a.) The Artist reserves all rights of reproduction. This includes reproduction of the image as prints or images on accessories, as well as producing similar paintings of the same image with the intention to sell.

b.) The Purchaser may only reproduce the Artwork upon advance written permission from the Artist in each instance (except for incidental noncommercial reproductions such as personal photographs of physical settings where the Artwork is displayed). The Artist’s signature and/or copyright notice as they appear on the Artwork at the time of sale shall not be removed or concealed.

c.) The Artist shall receive authorship credit in connection with the Artwork or any reproductions of the Artwork.

- Maintenance:

The Purchaser will not intentionally damage, alter, modify, or change the Artwork in any way whatsoever. If any alteration of any kind occurs after receipt by the Purchaser, whether intentional or accidental and whether done by the Purchaser or others, the Artwork shall no longer be represented to be the work of the Artist without the Artist’s written consent.

- Resale:

If the Purchaser re-sells the Artwork, the Purchaser shall pay to the Artist a resale royalty of five percent (5%) of the amount of such sale.

- General:

The Purchaser agrees to loan the Artwork back to the Artist for any shows or exhibitions (as required) for a specified and agreed upon amount of time.

- Shipping and Delivery:

The Purchaser covers the cost of shipping unless other arrangements are agreed upon with the Artist. If a courier or shipping company is involved with delivery, then the Purchaser agrees to deal directly with this third party i.e. the Artist does not make any financial transactions on behalf of the Purchaser or assume any responsibility of damages caused due to delivery by the third party. The Artist agrees to prepare standard packaging for the artwork i.e. bubble wrapped and serrated cardboard appropriate for shipping via a postal service. If a courier or shipping service requires additional packaging, then the Purchaser will cover the additional packaging cost. Once the artwork leaves the hands of the Artist, the Artist is not responsible for any shipping damage.

Coaching Disclaimer & Waiver

All coaching services and communication email or otherwise, delivered by Michelle Myrick | Art of Awareness Coaching as well as information on this website michellemyrick.com are meant to help you identify the areas in your life and in your thinking that may be standing in your way.

In some cases, coaching does not constitute as or substitute for professional mental health care or medical care.

If you feel psychologically stressed to the point that it is interfering with your ability to function, please have the courage to seek the help you need in the form of a professional counsellor.

Coaching may augment your therapy, but the work of coaching is most effective when major emotional and psychological wounds are already healed or in the process of being healed.

In that spirit, by purchasing coaching services from your Coach, you confirm that you have read and agreed to each statement and that you wish to proceed:

I understand that my Coach is not acting as a mental health counsellor or a medical professional.
I understand that the coaching services I will be receiving from Michelle Myrick is not offered as a substitute for professional mental health care or medical care and is not intended to diagnose, treat or cure any mental health or medical conditions.
I understand that coaching is, at present, an unregulated industry and that my Coach, even though she has studied and become certified, is not licensed by any internationally recognised regulator.
I understand that for all legal purposes, the services provided by my Coach will be considered to be provided from any remote location worldwide
I understand and agree that I am fully responsible for my well-being during my coaching sessions, and subsequently, including my choices and decisions.
I understand that coaching is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment, and I will not use it in place of any form of therapy.
I understand that all comments and ideas offered by my Coach are solely for the purpose of aiding me in achieving my defined goals. I have the ability to give my informed consent, and hereby give such consent to my coach to assist me in achieving such goals and aims.
I understand that to the extent our work together involves career or business, my Coach is not promising financial outcomes, increased clientele, profitability and or business success.
I understand that my Coach will protect my information as confidential unless I state otherwise in writing. If I report child, elder abuse or neglect or threaten to harm myself or someone else, I understand that necessary actions will be taken and my confidentiality agreement limited in this capacity. Furthermore, if my Coach is ordered by a court to provide information or to testify, they will do so to the extent of that the law requires.
I understand that the use of technology is not always secure and I accept the risks of confidentiality in the use of email, text, phone, Zoom, Skype and other similar technology.
I hereby release, waive, acquit and forever discharge Michelle Myrick | Art of Awareness Coaching | AMMO ARTWORKS INC., any agents, successors, assigns, personal representatives, executors, heirs and employees from every claim, suit action, demand or right to compensation for damages I may claim to have or that I may have arising out of acts or omissions by myself or by my Coach as a result of the advice given by my Coach or otherwise resulting from the coaching relationship contemplated by this agreement.
I further declare and represent that no promise, inducement or agreement not expressed in this agreement has been made to me to sign this agreement. This agreement shall bind my heirs, executors, personal representatives, successors, assigns, and agents.

An official AGREEMENT must be signed before coaching services ensue. Once coaching services have been purchased, you will be asked to sign an agreement.
